Lee Hornberger looks at Michigan’s court decisions since January 2011 that have concerned various Alternative Dispute Resolution issues. By reviewing various appellate cases issued on mediation and arbitration, complications can be better understood for future cases. The reviewed cases look at issues such as the arbitrator or mediator having a conflict of interest, prejudices against one of the parties, or where the motions were barred by general principles of equity.
