Step-parent of minor child, who was former domestic partner of biological mother, filed complaint against biological mother and adoptive parent, seeking custodial and visitation rights as psychological parent of child. Held: (1) as a matter of first impression, adoptive parent’s alleged lack of consent to step-parent’s performance of parental duties did not deprive step-parent of standing, and (2) fact issues as to consent and step-parent’s standing precluded summary judgment.
