Amendment to Oklahoma constitution defining “marriage” as only the union of one man and one woman intentionally discriminated between groups of persons, supporting lesbian couple’s claim that the amendment violated their rights to equal protection under the Fourteenth Amendment, where the amendment had disparate impact upon same-sex couples who desired to marry in Oklahoma, in that its effect was to prevent only same-sex couples in Oklahoma from receiving a marriage license, and its purpose was to exclude the class consisting of same-sex couples from marrying.
