Jay Fishman is one of the most highly respected valuation experts in the country. Jay is managing director of Financial Research Associates and he’s been actively engaged in the appraisal profession since 1974. He specializes in the valuations of business enterprises and their intangible assets. He has co-authored several books, including the highly acclaimed Guide to Business Valuations with Shannon Pratt, and Standards of Value with Shannon Pratt and William Morrison. He has taught courses on business valuation to the Internal Revenue Service, the National Judicial College, the Hong Kong Society of Accountants and on behalf of the World Bank in St. Petersburg, Russia. He’s the former chairman of the business valuation committee of the American Society of Appraisers, editor of the Business Valuation Review, chair of ASA’s government relations committee, former trustee of the Appraisal Foundation, a member of the Appraisal Standards Board of the Appraisal Foundation and vice-chair of the Appraisal Practice Board of the Appraisal Foundation. What do you see as the value of attending the AICPA AAML National Conference on Divorce?
It’s a unique opportunity both for accountants and lawyers to find people who deal with these issues every day. It’s a two-fold benefit. The first is obviously the presentations and the formal give and take, but it will also give you the opportunity to rub shoulders. Everybody who participates is a teacher in one way or another. That’s one of the things that we do in divorce, we teach. It gives you an opportunity to talk to people both formally and informally. It’s a wonderful program. I’ve done it a number of times and I walk away learning things as well.
What level of lawyer would you suggest attend this conference?
The people who deal with high net worth divorces, that cover lots of different topics: accounting, tax, trusts, valuation. It’s an ever-changing field. There are things that even the experienced practitioner would learn. Also for the person who’s just starting out, it gives not just an overview but a way to build relationships. I always tell people, if you have an expert you work with, you shouldn’t feel embarrassed to pick up the phone and ask him a question. It doesn’t mean you have to charge for it. It’s kind of a networking opportunity for everybody.
What will you be speaking on at the Conference?
I’m going to attack some of the more controversial and ambiguous areas in valuation for divorce purposes: the whole issue of separating personal from enterprise, saleable personal goodwill vs. enterprise goodwill, how to measure active to passive. I’m aware of all the models used and their pitfalls, and also how to conduct yourself with an expert in a business valuation issue for divorce purposes. I’m going to cover those three areas.
The other advantage of this seminar is everybody who’s asked to speak is pretty practical. These aren’t academics. These are people who actually work in this field, have come across these issues and have had to deal with them.
